PRIVACY STATEMENT FOR KONE ELEVATOR CALL MANAGER SOFTWARE

This privacy statement provides general information on the processing of certain below specified personal data in connection with KONE Elevator Call Manager Software ("Manager SW").

1. Data Controller and contact information

All personal data collected through and in relation to the Manager SW is controlled by the local KONE group company with whom the contract for providing the Manager SW has been concluded. The Manager SW is managed and supported in a centralized manner by KONE Corporation, who acts as a parallel data controller together with the relevant local KONE entity.

2. Personal data

Following information is collected and processed in connection with Manager SW:

- Name

- Company

- User ID

- Contact information; e-mail address, address, phone number

- Other personal data you enter into the Manager SW

- Usage records and logs; successful and unsuccessful actions you conduct in the Manager SW such as; add / delete user, add / modify authorization, failed authoritative actions, failed authentication record

If you enter any information concerning any other natural person than yourself into the Manager SW, you must ensure you have received such other person's consent to do so before entering the information into the Manager SW.

3. The purposes of the processing

The purpose why personal data is processed is to:

- enable functioning of the Manager SW

- analyze how the Manager SW is used

- analyze and correct any possible defects in the Manager SW

- ensure security of the personal data collected of you when you use the Manager SW

- monitor and ensure security of KONE equipment, the building and end-user data accessible through the Manager SW

Moreover, KONE may use your personal data for the purpose of concluding the agreement under which the Manager SW is provided, such as invoicing, contacting you or providing you the services as agreed as well as monitoring and verifying that such services are provided and used as agreed. Such services may include e.g. user communications, analyzing of how KONE Elevator Call Manager SW and KONE equipment is being used and analyzing and correcting of any possible defects in the KONE services or KONE equipment.

KONE may, as allowed by applicable national laws, use personal data for establishment, exercise or defense of legal claims.

After anonymizing personal data, KONE may process such anonymous data also for other purposes such as product, service and application development.

Processing of your personal data is based on the consent you give when you start using the Manager SW as well as legitimate interest of KONE that relates to providing the services as agreed, enabling the use of the Manager SW and ensuring security of KONE equipment, the building and the personal data accessible through or collected with the Manager SW. Depending on the applicable law, personal data processing may also be based on a legal requirement applicable to KONE (such as accounting or data disclosure obligations).

Processing of personal data is necessary for KONE to be able to provide the Manager SW and services as agreed in the Agreement. If you do not approve of the collection and use of your personal data, or withdraw the consent you have given for processing of the personal data, you may not use the Manager SW.

4. Source(s) from which the personal data originate

The personal data is obtained directly from you or generated when you use the Manager SW.

5. Transfers of personal data

KONE may use reliable subcontractors' services when processing personal data for the abovementioned purposes. To the extent such subcontractors have access to personal data or host personal data, KONE shall ensure through contractual arrangements that such subcontractors use the personal data only to the extent necessary to perform such services and that subcontractors are committed to relevant confidentiality, data privacy and data security obligations. KONE Corporation may transfer personal data to its affiliates and subsidiaries.

Due to the technical and practical requirements, some of the personal data may be processed also outside the EU/EEA by the subcontractors or other KONE companies. KONE ensures that there is a legal basis for such transfers and you can get more information about the data transfers by contacting KONE.

KONE may transfer personal data to the customer who has purchased the usage right of the KONE Elevator Call services in a designated building.

Your personal data may be disclosed to public authorities in situations where the applicable local law explicitly demands and allows KONE or the customer to do so.

6. Retention period of the personal data

KONE will store Personal Data during the term of the agreement under which the Manager SW is provided. Certain log data collected of the use of the Manager SW needs to be retained also after expiry of the agreement to ensure an intact audit trail for security purposes. In case personal data is processed for the establishment, exercise or defense of legal claims, personal data is retained as long as necessary to resolve the case, and thereafter the data is archived and retained as required by applicable national laws and regulations. Otherwise KONE will process personal data as long as it is necessary for the abovementioned purposes.

7. Data subjects' rights

You have a right to review the personal data collected on you, right to have incorrect data corrected, outdated or unnecessary data deleted and right to withdraw your consent. Depending of the applicable law, you may also have right to object processing based on a specific individual circumstance and request data portability. You may use some of these rights through the Manager SW. If this is not possible, you may use these rights by contacting KONE.

In the event you have concerns or remarks regarding legality of Personal Data processing you may lodge a complaint with a competent, local data protection supervisory authority.
